This long-running case involved a client charged with numerous different offences across multiple briefs. There were a large number of allegations of VRO breaches, as well as multiple serious assault allegations.

Following successful negotiations, we were able to secure a plea deal to plead guilty to only two of the least serious VRO breaches, with the large amount of remaining allegations to be discontinued.

The assault allegations were not able to be resolved despite extensive attempts at negotiation.

What followed was a lengthy trial of several days’ duration before a Magistrate.

At trial we engaged in extensive preparations to cross-examine the complainant and various other prosecution witnesses, including medical experts. Our trial strategy exposed numerous deficiencies in the evidence, both from the complainant and also from various other witnesses.

We also led extensive evidence from the client which was instrumental in raising doubt as to the truthfulness of the allegations.

Following a lengthy and detailed decision from the Magistrate, our client was acquitted of four of the alleged serious domestic violence offences.

This great result meant that at sentencing the client went from facing almost certain jail time, to the most likely outcome being a fine. The client was very happy with the outcome and thanked us for our work on the matter.
